Ticket Path For Texas owners

The practice is in Dallas. The receipt can be anywhere in the state. The file is shared on a screen.

Dallas, and a screen share

The practice is in Dallas. Steven Palmieri keeps this receipt work there in the Tax CFO role, the same role owners call the Entrepreneur's CFO. We keep the books, we prepare the return from those months, and we decide the next Saturday while this month is still open. A Texas owner does not drive the receipt to Dallas. The file is shared. Whichever side of the state the dining room is on, the close still lands on the day we already named.

Inside Dallas we speak as neighbors, because that is where the practice is. Outside Dallas and Fort Worth we do not claim a table, a trail, or an office. We are all Texans. We can picture the place the way you can, and the work is still remote. Video call, shared books, the same close.

Places a Texan already knows

Lower Greenville, between Mercedes and Belmont, is the restaurant stretch we know as neighbors. A plate and a drink in the same minute still have to stay apart on the receipt. Trinity Groves sits under the Margaret Hunt Hill Bridge, a yard of restaurants we pass. A deposit from a night like that should carry only what remains after the fee. People still line up at Pecan Lodge in Deep Ellum for brisket, and we understand the wait. The line is one marker. One income number is the wrong marker for food, a drink, a gift card, and a tip.

A blue norther drops the temperature over Dallas, and we feel that front the same evening you do. The named day still closes the month. The cold does not move the closing date. Since 1918 the downtown El Fenix table has been a Wednesday enchilada for neighbors, and we still talk about that plate. Neighbors still talk about that Wednesday plate, and we do too. A plate that repeats every week still has a food line and, if the table ordered a drink to be consumed there, a different line.

Since 1952 we have used Big Tex, the figure in the middle of the State Fair at Fair Park, to find each other in that crowd. A single marker is easy to spot. A single income line is easy to spot too, and it is the wrong marker for a whole service. The Sixth Floor Museum fills the sixth floor of the old Texas School Book Depository on Dealey Plaza, and we can name that building the way anyone who knows downtown can. Naming a building is not the same as claiming every entrance downtown is the same shop. Northwest of downtown, the Design District left the warehouse years behind and filled in with showrooms, galleries, and restaurants. We know that change as neighbors. A building that changed jobs still needs the paper that says which purchase was a fryer and which was a chair.

The Fort Worth Water Gardens, designed by Philip Johnson and John Burgee, opened in 1974 and fill the south end of downtown next to the convention center. The gardens are a picture of downtown, not a room we work from, and this practice keeps no office in Fort Worth. We are neighbors in the same metro, and a Saturday of tickets still has to say which dollars were food and which were a card a guest has not spent.

The Congress Avenue Bridge over Lady Bird Lake shelters the largest urban bat colony, and every Texan has a picture of that dusk even if the picture is someone else's. That dusk picture is someone else's bridge. This practice keeps no Austin office and does not stand on the span. Owners in Austin share a screen with us, and the close still lands on the day already named. Houston's bayou trail, Buffalo Bayou Park, opened in 2015 and runs from Shepherd Drive to Sabine Street near downtown. Every Texan can picture a walk there without our claiming we took it this week. This practice keeps no Houston office and does not claim that trail as a commute. The tip item does not depend on which side of the state the dining room is on.

San Antonio's open-air stage, the Arneson, was built on the River Walk between 1939 and 1941, a level below the street. The walk itself sits a level below the street, and every Texan has a picture of it. The stage is a picture we share as Texans. Our work with owners in San Antonio is a shared screen, and we keep no office beside that stage. A night that looks busy from the street can still have the drinks filed in the wrong center.

Two alcohol forms, and the Comptroller's arithmetic

One sales tax payable account cannot carry both mixed beverage taxes and the limited sales tax on food. The 6.7 percent gross receipts tax is the restaurant's own tax, and it is not added onto the guest's price. The 8.25 percent mixed beverage sales tax may be added or folded into the price, and the file should keep one method. Those two amounts want two liability names. Collapsing a plate and a drink consumed at the table into one income account is how the sales tax return and the mixed beverage forms stop agreeing. The night can feel like one sale. The Comptroller's two forms cannot read it that way.

Gross receipts tax is filed on Form 67-100. Mixed beverage sales tax is filed on Form 67-103. Both sit outside the limited sales and use tax return. Both are monthly. Both are due on the 20th of the next month even when the bar sold nothing. There is no timely filing discount. A report filed late draws a 50 dollar penalty even if no tax was due. A late payment adds a 5 percent penalty in the first 30 days and 10 percent after that. Alcohol sold to go, and not consumed on the premises, leaves those two liabilities and takes limited sales tax instead.

A mixed beverage permittee pays the 6.7 percent on alcohol and on ice and mixers sold to be mixed with alcohol and consumed on the premises. The guest pays the 8.25 percent on those same sales. Beer and wine follow the permit. A wine and malt beverage retailer's permit is not a mixed beverage permit, so those sales take ordinary sales tax instead. There is no exemption from mixed beverage gross receipts tax, including for entities that are exempt from sales tax.

When the 8.25 percent tax is included in the price, the Comptroller's example starts from 1,000 dollars of receipts, divides by 1.0825, and reports 924 dollars of taxable mixed beverage sales. The 6.7 percent tax is then figured on 924 dollars, not on a base that still includes the sales tax. We do not invent a check for your bar. We use the file's own receipts. Both mixed beverage taxes can be filed in Webfile. They are not the same report. We do not teach a click path inside the software. We name the boundary so the items point at the report that actually wants them.

Food a restaurant sells ready to eat is taxable in Texas even when the customer takes it to go. Bakery items are not taxed when they are sold without plates or eating utensils. A point of sale closeout has to know which of those it sold, because the receipt items are what the return will read. Putting alcohol in the sales tax center because the software offered a rate is how the two systems drift.

A card, a coupon, and a tip

Texas sales tax on a restaurant gift card waits until the guest redeems it. That timing is why the item points at a liability on the day of sale. Redemption moves the liability toward food. Pointing the item at income on the sale day recognizes a meal the kitchen has not cooked. If the card and the plate share one item, the sales tax return cannot see the timing the Comptroller already wrote down.

A coupon is a discount for Texas sales tax when the restaurant is not reimbursed for it. A five dollar coupon against a fifteen dollar meal means tax is due on ten dollars. A complimentary meal or drink is not a taxable sale. Tax can still be due on taxable ingredients, such as soft drinks given away. Raw meat and vegetables used in that complimentary meal are not taxable items. The row in Ask My Accountant is often one of these, sitting there because the receipt had no item for it.

A voluntary tip is not subject to Texas sales tax. The tip sits on a liability named for the staff until the payout leaves. A mandatory gratuity of 20 percent or less is not taxed when it is clearly labeled as a tip or gratuity and is paid only to employees who regularly provide the service. A mandatory gratuity above 20 percent is taxable. On mixed beverage taxes, a mandatory gratuity over 20 percent is taxable in full no matter who receives the money.

Under 20 percent, any part disbursed to a nonqualified employee, such as a chef, cashier, or dishwasher, or kept by the owner, is taxable. Servers, bussers, bartenders, wine stewards, and the maitre d are the qualified employees for that rule. One combined item hides the split. An employee who receives 20 dollars or more in cash tips in a calendar month from one employer reports those tips in writing by the 10th of the next month. We set the item up. The paycheck itself stays with the provider already running payday for that dining room. This page stops before any paycheck is produced. A service charge counts as wages rather than a tip, and it stays out of the employer tip credit.

A fryer, a certificate, and use tax

Listed kitchen processing equipment used to prepare food for sale, such as ovens, fryers, grills, and slicers, can be bought without Texas sales tax when an exemption certificate is given. Hand tools are outside that list. Tables, chairs, dishes, and dishwashers are taxable purchases. The bill in the file has to remember which certificate was used. The asset still exists for income tax.

Paper napkins, plastic utensils, straws, and fry bags given to the customer with the meal can be bought without sales tax with a resale certificate. Natural gas, electricity, pest control, security, janitorial work, waste removal, and real property repair are taxable to the restaurant. Use tax is due on taxable goods bought from an out of state seller who did not collect Texas tax.

The franchise report for 2026

For the 2026 Texas franchise tax report the no tax due threshold is 2,650,000 dollars. The rate is 0.375 percent for a qualifying retailer or wholesaler and 0.75 percent for other entities. A restaurant that prepares the food it sells has to answer whether it produces a product it sells before taking the retail rate. Using the retail rate when the code on the report does not qualify gets the rate denied. That question is named here. It is not answered for a file we have not seen.

A large food or beverage establishment also compares reported tips with 8 percent of gross receipts from food and beverages. Carryout and receipts with a service charge of 10 percent or more are left out of that federal test. We can show you the comparison from the receipt. We do not file the pay. The franchise question and the federal tip comparison are different pieces of paper. Both of them need the receipt items to be true before either number is worth reading.

What to send from anywhere in the state

Send one daily sales receipt, or one week of them, with guest names covered. A week of batches is enough for the first look. You do not need the year tidied before we can see which Saturday never met the bank. If a gift card item exists, send the item. If a card batch is still open, send the batch and the deposit that was supposed to match it. If alcohol was filed inside the sales tax center, say so. If the price includes the 8.25 percent, say that too, because the method has to stay consistent and the 6.7 percent is never added on top of the guest's price.

We will not edit a filed month to force a redemption or a payout to match an old deposit. The closing date stays shut. A figure for the work waits until the objects are counted. Daily receipts, open batches, gift card items pointed at income, alcohol sitting inside the sales tax center, and months past the lock. No hourly table from a blog is used.

The number printed with the signoff is the same practice that would read the receipt. A video call is the meeting, whether the dining room is in Dallas or on the other side of the state. Name the items before the Comptroller's form and the federal return both ask for the same night.
